Standard Chartered “Online Banking Campaign” Weekly Contest (“Weekly Contest”)
and “My Bizarre Online Moment” Photo Contest (“Photo Contest”)
Terms and Conditions:
 
1. Standard Chartered Bank Malaysia Berhad (“the Bank”) will run Online Banking Campaign (“Campaign”) from 27th April 2009 to 21st June 2009 (“Campaign Period”).
     
2. During the Campaign Period, customers stand to win the following prizes:
     
  2.1 Weekly Contest: THREE (3) prizes every week during the Campaign Period:
a) Grand Prize: Cash of RM3000
b) First Prize: Cash of RM2000
c) Second Prize: Blackberry Bold
     
  2.2 Photo Contest: THREE (3) prizes during the Campaign Period
a) Grand Prize: Cash of RM8000
b) First Prize: Cash of RM5000
c) Second Prize: Cash of RM3000
     
  2.3 All cash prizes will be credited into the respective winners’ e$aver account with the Bank or Saadiq$aver account-i with Standard Chartered Saadiq Berhad (“Saadiq”), as the case may be. If any winner does not have such an account, they must open such an account within 30 days from the date of notification of winning by the Bank. If they fail to do so, their prize will be forfeited and another winner will be selected in accordance with clauses 7.1(a) or 7.1(b), as the case may be.
     
  2.4 All prizes will be delivered or credited only within 4 to 6 weeks after the end of the Campaign Period.
     
3. Prize Winning Eligibility:
     
  3.1 The Weekly Contest and Photo Contest are open to all Individuals aged 18 and above who have maintained their accounts with the Bank and with Saadiq in good standing, without any breach of the relevant terms and conditions or agreements, throughout the Campaign Period (“Eligible User”).
     
  3.2 Where the same Eligible User submits multiple entries for the Photo Contest, the Bank will accept only the first in time to be received by the Bank. All other entries by that Eligible User will be disregarded.
     
  3.3 Each entry for the Photo Contest must be submitted via email and accompanied by the name, identity card/passport number and mobile phone number of the Eligible User. The mobile phone number provided must be the same as the number in the Bank’s records.
     
  3.4 By submitting a photograph for the Photo Contest (“Photo Entry”) the Eligible User represents and warrants that he owns all rights to use and publish the Photo Entry, and irrevocably consents for the Bank to use or publish the Photo Entry. The Eligible User agrees and undertakes to indemnify the Bank for any and all claims, proceedings, losses, damages, demands, liabilities, costs and expenses suffered or incurred by the Bank in the event the Photo Entry is found to be in breach of any intellectual property rights of any other party.
     
4. Eligibility Criteria:
     
  4.1 The Eligible User must have made a minimum of 3 bill payments to 3 different merchants within one week via Standard Chartered Online Banking, with the total payments made amounting to a minimum of RM100.00 (collectively “Qualifying Transactions”).
     
  4.2 Transactions are attributed based on the Username logged in for that transaction.
     
  4.3 For Weekly Contests, all Qualifying Transactions must be made within the relevant week.
     
  4.4 For the Photo Contest, all Qualifying Transactions must be made within the Campaign Period.
     
5. Closing Times:
     
  5.1 To participate in Weekly Contests, the Eligible User must make all Qualifying Transactions for that week before midnight (Malaysian time) on the last day of the relevant week as set out below:
 
Week 1: 27th April 2009 to 3rd May 2009
Week 2: 4th May 2009 to 10th May 2009
Week 3: 11th May 2009 to 17th May 2009
Week 4: 18th May 2009 to 24th May 2009
Week 5: 25th May 2009 to 31st May 2009
Week 6: 1st June 2009 to 7th June 2009
Week 7: 8th June 2009 to 14th June 2009
Week 8: 15th June 2009 to 21st June 2009
     
  5.2 All entries for the Photo Contest must be submitted via email to the designated email address (bizarre.contest@sc.com.my) and received before midnight (Malaysian time) of 21st June 2009 (“Closing Date”). Late entries received at or after midnight of the Closing Date will not be accepted for the Photo Contest, irrespective of when they were sent. The Bank’s records are final and conclusive for purposes of determining time of receipt.
     
6. Potential Winner Selection Method:
     
  6.1 Weekly Contest:
     
   
a) All entries which fulfill the eligibility criteria set out in clause 4 within each relevant Prize period (“Qualified Entries”) will be accumulated, and listed, whereby each Qualified Entry will be assigned a computerized serial number, and all Qualified Entries sorted in ascending order based on the serial number.
b) The 88th, 188th and 288th Qualified Entries within each Contest Week will win that Weekly Contest Grand Prize, First Prize and Second Prize respectively.
c) This computation will be done weekly during the Campaign Period.
     
  6.2 Photo Contest:
     
   
a) All Photo Entries amassed during the Campaign Period will be assessed by a panel of judges based on how the photo depicts the theme of “The Convenience of Banking in the Most Inconvenient Times”.
     
7. Winner Notification:
     
  7.1 Weekly Contest:
     
   
a) Each potential winner will be notified via the mobile phone number in our records. Should a potential winner fail to be contacted on the first attempt for, another attempt will be made within the next one (1) day of the first attempt. Where the second attempt is unsuccessful, the Bank reserves the right to select another potential winner as described in paragraph (b) below.
b) In the event any potential winner selected cannot be contacted or otherwise forfeits his rights to the prize, the Bank will select another potential winner, being the person whose Qualified Entry is next on the list of Qualified Entries for the relevant prize week.
     
  7.2 Photo Contest:
     
   
a) The Eligible User who submitted the winning entry selected by the panel of judges (“Selected Entrant”) will be contacted for verification.
b) Each Selected Entrant will be notified via the mobile phone number in our records. Should a Selected Entrant fail to be contacted on the first attempt for any reason, another attempt will be made within the next one (1) day of the first attempt. Where the second attempt is also unsuccessful or the Selected Entrant otherwise forfeits his rights to the prize, the panel of judges will select another entry.
     
8. Winner Eligibility:
     
  8.1 There will be only one (1) winner for each Prize.
     
  8.2 Each person is entitled to win only one (1) Prize within each Contest throughout the Campaign Period. Where an Eligible User becomes the potential winner of more than one prize, he will be entitled only to the prize which was first in time.
     
9. The Bank reserves the right to substitute any prizes, whether in whole or part, with items of similar value at any time without prior notice.
     
10. Prizes are not transferable, and non-cash prizes are not exchangeable for cash in whole or in part. The Bank will not be liable to compensate prize winners who are otherwise unable to enjoy their prize for any reason whatsoever.
     
11. Prizes will be delivered to addresses within Peninsula Malaysia or East Malaysia only. P.O. Box and overseas addresses will not be entertained. Please allow 6 to 8 weeks for delivery of prizes. In any event any Winner does not accept delivery of the prize within 30 days of the date he/she is notified, the Prize will be given to the next potential winner or Selected Entrant in accordance with Clause 7. The Winners consent for their relevant particulars to be disclosed to merchants or other agents of the Bank for delivery of the Prizes, and agree that such merchants or agents may contact the Winners directly in respect of such delivery arrangements.
     
12. The Bank makes no representation or warranties with respect to the Prizes given in this Campaign and in particular makes no warranties with respect to the quality of the Prizes or their suitability to any purpose. All Winners acknowledge that they must liaise directly with the relevant merchants to resolve any disputes over the Prizes. The Bank shall not be responsible for nor shall it accept any liability of whatsoever nature arising directly or indirectly from the Campaign and/or the Prizes howsoever arising and suffered by any persons.
     
13. The Bank’s decision on all matters relating to this Campaign including but not limited to the selection of the Winners for the Prizes will be final and binding on all persons participating in this Campaign, and no correspondence will be entertained. Any matters not covered by these Terms and Conditions shall be determined solely by the Bank at its discretion.
     
14. Notwithstanding anything contained herein, the Bank reserves the right to withdraw any winning notification and/or to replace a Winner in the event such Winner is subsequently found to be disqualified by any reasons whatsoever.
     
15. By participating in this Promotion, Eligible Users hereby consent to and agree that the Bank shall be at liberty to publish their names, pictures, city of residence and identity card/passport numbers for advertising and publicity purposes.
     
   
16. The Bank reserves the right to cancel, terminate or suspend this Campaign with or without prior notice. For the avoidance of doubt, cancellation, termination or suspension by the Bank of this Campaign shall not entitle the Eligible Users, Potential Winners or the Winners to any claim against the Bank for any and all losses or damage suffered or incurred by any party as a direct or indirect result of the act of cancellation, termination or suspension.
     
17. The Bank reserves the right at its absolute discretion to amend, delete or add to any of these Terms and Conditions from time to time without prior notice.
     
18. By participating in this Campaign, each Eligible User agrees to be bound by these Terms and Conditions.
