2009 Standard Chartered Choice Rewards Programme’s Terms & Conditions

 
   
 
Definition and Interpretation
 
1. “Choice Points” means the points awarded to the Cardholder under the SCCR in accordance with these terms and conditions.
2. “Catalogue” means this catalogue, and may either be in print or electronic version.
3. “Cardholder” means a principal credit cardholder of a Standard Chartered Credit Card.
4. “Credit Card” means a Visa and/or MasterCard credit card issued by Standard Chartered Bank Malaysia Berhad (“the Bank”).
5. “Quick Redemption” is a redemption option that allows the Cardholder to redeem Gifts by using a combination of Choice Points and a Ringgit value portion fixed under the SCCR.
6. “Gifts” are defined as goods, vouchers, services, magazines and other privileges as may be contained in the Catalogue and also includes other Rewards. This list is not exhaustive and may be subject to changes and/or variation by the Bank any time at its sole and absolute discretion.
7. “Good Standing” is used to define a Credit Card account that is currently not overdue in payment, has not exceeded its credit limit, is not going to be
8. Closed upon its card expiration date, is not cancelled nor terminated by the Cardholder or by the Bank.
9. “PMP” means Partner’s Miles Programme e.g. Malaysia Airlines Enrich Miles.
10. “SCCR” means Standard Chartered Choice Rewards Programme.
11. Words importing the singular include the plural and vice-versa, words importing a gender include both genders, and references to persons include bodies corporate and unincorporated.
12. The headings to the clauses of these terms and conditions are for convenience only and have no legal effect. All references to “Clauses” are to clauses contained herein.
13. “Working day” shall mean a day, which is not a Saturday, Sunday or a public holiday in the Federal Territory of Kuala Lumpur.
Eligibility
 
1. The SCCR is a programme for Cardholders of Credit Cards issued by the Bank excluding Corporate Credit Cards, and whose Credit Card accounts are of Good Standing only, and is based upon the terms and conditions contained herein.
Earning of Choice Points
 
1. Choice Points are awarded to the Cardholder for each ringgit spent based on the total posted Ringgit Malaysia (“RM”) amount of retail purchases (local and international) made on the Credit Card, including any supplementary Credit Cards. The Bank will not be liable for any delay in the actual posting of the transactions and/or Choice Points during the SCCR. The Bank reserves the right to amend or modify the manner in which Choice Points are awarded.
2. Cash advances or cash withdrawals, charges for cash advances or cash withdrawals, annual fees for the Credit Card, interest and/or finance charges, disputed transactions, any type of balance transfers, any type of installments payment plans, and any other kind of charges and/or penalties will not be included in the calculation of Choice Points.
3. Choice Points earned by the Cardholder are valid for a maximum period of three (3) years only. The expiry date of Choice Points expiring in a particular year shall be on the last day of the expiry month of the Credit Card and where Cardholders have more than one credit card such date as may be determined by the Bank to be the expiry date. All Choice Points must be redeemed prior to its expiry.
4. Choice Points are accrued in the name of the Cardholder only and cannot be transferred to another Cardholder. Choice Points redemption may only be done by the principal Cardholder before the expiry of the Choice Points and provided always that the Cardholder’s Credit Card account is of Good Standing.
5. In the event a Cardholder of Good Standing has more than one Credit Card account and chooses to close one or all of his Credit Card account(s), the existing Choice Points acquired from the closed Credit Card account(s) must be redeemed prior to the date the Credit Card account(s) is closed. Once a particular Credit Card account is closed, all unredeemed Choice Points will be automatically cancelled. For the avoidance of doubt, no transfer of Choice Points between a Cardholder’s different Credit Card accounts is allowed.
6. The Bank has the sole discretion to cancel or suspend a Cardholder’s redemption of Choice Points, without assigning any reasons thereof. For the avoidance of doubt, Choice Points earned on any Credit Card account thirty (30) days or more past its payment due date, or Credit Card accounts believed by the Bank to be operated fraudulently or any Credit Card account closed by the Bank will be cancelled.
Gift Redemption
 
1. Once a redemption request has been accepted by the Bank, it cannot be revoked, cancelled, returned or exchanged by the Cardholder.
2. In the event, the Cardholder’s Credit Card is not of Good Standing or the Credit Card has insufficient Choice Points, the request for redemption of Gifts will be rejected automatically without any notification to the Cardholder.
3. Once the accumulated Choice Points in a Cardholder’s Credit Card account has been redeemed for any Gift in the SCCR, such Choice Points cannot be transferred back to Cardholder’s Credit Card account and such Choice Points shall be deemed extinguished.
4. A Cardholder who chooses to redeem the Gifts via the Quick Redemption option hereby irrevocably authorises the Bank to debit his Credit Card account to pay the said RM value portion of the redemption. The Bank will not accept any other mode of payment for Quick Redemption.
5. The Bank does not accept any liability whatsoever (including but without limitation, liability for negligence) with respect to Gifts supplied or in connection with any merchant/supplier’s refusal to accept any vouchers and/or confirmation letters relating to Gift redemption being redeemed and/or presented by the Cardholder from and/or to the merchant/supplier. The rights, if any, which the Cardholder may have in connection with a Gift is solely against the merchant/supplier of the Gift.
6. By conducting the SCCR, the Bank does not accept any liability, including but not limited to liabilities with respect to death or injury or consequential loss or damage of whatever nature and howsoever arising from the redemption or supply of the Gifts, including but not limited to any injury or loss suffered by the Cardholder and his accompanying persons whilst on holiday pursuant to the hotel and/or holiday package redeemed with the Choice Points and/or any delay or cancellation in the transportation facilities and/or accommodation facilities (where applicable) and/or resulting from any advice, pointers, tips and directions as may be contained in this Catalogue or any other publication issued by the Bank or from the loss, theft, and/or destruction of the Gifts.
7. The Bank gives no representation or warranty with respect to the Gifts provided under SCCR. In particular, the Bank gives no warranty and/or representation with respect to the quality of Gifts or their suitability for any purpose. Notwithstanding any provisions to the contrary herein contained, any dispute concerning the goods and/or services redeemed as Gifts under SCCR shall be settled as between the Cardholder and the participating merchant/supplier directly. The Bank will bear no responsibility for resolving such disputes or for the dispute itself.
8. Gifts that consist of certificates and/or vouchers and/or any type of written communication issued by participating merchants/suppliers under SCCR cannot be encashed and cannot be used in conjunction with any other promotion or offer. The certificates and/or vouchers and/or any type of written communication are valid for use until the date specified on the certificates and/or vouchers and/or any type of written communication. If they remain unused after this date, they will totally lapse and will not be replaced. The use of the certificates and/or vouchers and/or any type of written communication are subject to the terms and conditions contained therein and are valid for use only at participating merchants/suppliers under the SCCR and only for the specific matters mentioned therein.
9. In circumstances where the certificates and/or vouchers state a specified amount (Ringgit), and if is used for a value less than the amount mentioned, the difference cannot be encashed. In the case where the value of the certificates/vouchers is less than the value of the item(s) purchased, the Cardholder is obliged to pay the difference in cash or by his Standard Chartered Credit Card to the participating merchant/supplier.
10. 10. In the event a Cardholder’s choice of Gift is unavailable, the Bank reserves the right to replace it with a substitute of similar value. All Gifts are available while stock lasts and the Bank reserves the right, without giving any prior notice nor assigning any reason whatsoever to the Cardholders, to discontinue and/or replace all or any of the products or services featured herein or any other related material published by the Bank, with different products, models, colour or services which may be redeemed as Gifts.
Frequent Flyer Programme
 
1. Cardholders may choose to convert his Choice Points to PMP points provided (a) such Cardholders are already registered with the PMP prior to redemption of Choice Points, and (b) the Cardholders inform the Bank of his own PMP membership number at the point of redemption.
2. Once Choice Points are converted into PMP points, the PMP points cannot be reconverted into Choice Points thereafter. For the avoidance of doubt, the conversion of the Choice Points into PMP points shall take not less than twenty-one (21) to forty-two (42) days for completion of conversion and the Bank is under no obligation to effect a manual transfer.
3. The Bank reserves the right to revoke and withdraw participation of the PMP from the SCCR and the right to change the conversion rate offered hereunder.
4. The Bank reserves the right to adjust the number of resulting PMP points or the remaining number of Choice Points if any error has been made in the conversion process.
5. The Cardholder has to notify the Bank on any errors in the conversion of the Choice Points within one (1) month of the transaction date. The Bank will not be liable for lost points if Cardholder does not report it within the said period.
Bonus Gift
 
1. To be entitled to redeem a bonus gift, the Cardholder has to make one or more simultaneous redemptions totalling not less than 15,000 Choice Points (“Qualifying Redemption”).
2. The bonus gift must be redeemed together with the Qualifying Redemption.
3. The Bank will not entertain any late bonus gift redemption after the time of the Qualifying Redemption.
4. Cardholder is only entitled to redeem 1 (one) bonus gift during the Qualifying Redemption. For every Qualifying Redemption, the Cardholder is only entitled to redeem 1 bonus gift, irrespective of the total number of Choice Points used.

Cardholder may select the bonus gift of his choice from the available items under the respective tiers below, based on the Choice Points used under the Qualifying Redemption.

6. Subject to paragraph 4, Cardholder who qualifies for a lower tier is not allowed to redeem a bonus gift available under a higher tier. However, Cardholder who qualifies for a higher tier is allowed to redeem any bonus gift available under a lower tier.
Choice Points Purchase
 
1. Choice Points can be purchased at RM10 for 1,000 Choice Points at the time of making any redemption, subject to a maximum of 10,000 Choice Points.
2. A Cardholder who chooses to purchase Choice Points hereby irrevocably authorises the Bank to debit his Credit Card account to pay for the cost of the Choice Points. The Bank will not accept any other mode of payment for the purchase of Choice Points.
3. Choice Points will not be awarded to the Cardholder for the purchase of Choice Points and such purchases will be treated as retail charges which are subject to finance charges and late charge fee in the manner as stipulated in the Standard Chartered Visa and/or MasterCard Cards Cardholder Agreement.
Platinum "Wish List" Programme
 
1. a) Platinum Credit Cardholders ("the Requesting Cardholder") may request for redemption of such item(s) which are not featured in the Catalogue ("Other Reward(s)") subject to the conditions that the Other Rewards (i) are readily and lawfully available in Malaysia for the Requesting Cardholder, (ii) are not, in the sole opinion of the Bank, illegal, offensive or of unsuitable nature in relation to the Requesting Cardholder and PROVIDED ALWAYS that the Bank has the sole and absolute discretion in refusing requests for redemption of any Other Reward(s) without assigning any reason therefore and the Bank’s decision herein shall be final and conclusive.
2. b) Nothing herein shall be deemed as imposing any obligation or duty on the Bank to source for and provide any Other Rewards.
2. The Platinum “Wish List” is exclusive to the Bank’s Platinum Cardholders.
3. The Bank will confirm the availability and the number of Choice Points needed to redeem the item requested within 10 working days from the date of receipt of Cardholder’s request.
Delivery of Gifts
 
1. Cardholders shall provide a valid delivery address in Malaysia to the Bank for delivery of Gifts. Delivery will not be made to a P.O. Box address.
2. The Gifts will be delivered within twenty-one (21) working days (Peninsula Malaysia) or thirty-one (31) working days (East Malaysia) upon the Bank’s receipt of the Standard Chartered Choice Points Redemption Form. There will be a redirection fee of Ringgit Ten (RM10) only (to be billed to the Cardholder’s Credit Card account) for any change in delivery address.
3. Proof of delivery of Gift is by way of written acknowledgement of receipt of the Gifts by occupants at the delivery address (irrespective of whether or not such occupant is the Cardholder), and where such address is an office, receipt by an office staff shall be deemed to be the acknowledgement of the Cardholder. Such recipients of Gifts (whether Cardholder or non-Cardholders) are obliged to present identification documents such as their National Identity Card and/or passports to the delivery agent, failing which the delivery agent has the right to refuse delivery and will return the Gifts to the Bank.
4. If a Cardholder does not receive the Gift upon the expiry of twenty-one (21) working days (Peninsula Malaysia) or thirty-one (31) working days (East Malaysia) from the date of receipt by the Bank of the Standard Chartered Choice Points Redemption Form, the Cardholder shall not later than two (2) months thereafter, inform the Bank of the non-receipt of the Gift. The Bank will arrange for the delivery of the Gift to the Cardholder upon receipt of proof of non delivery of the Gifts from its delivery agent.
5. The Cardholder shall have no right of recourse against the Bank whatsoever upon the expiry of the said two (2) months and the Cardholder shall be deemed to have had received the Gifts arising from the redemption of the relevant Choice Points.
6. The Cardholder must examine the Gift immediately upon delivery. The Cardholder must contact the Standard Chartered Customer Service to inform the Bank of any damaged, defective and/or faulty Gift and must return the Gift immediately within three (3) working days to such place and/or person as directed by the Bank and/or to reject delivery of the Gift at the time of delivery. A replacement will be delivered within fourteen (14) working days after the return of the Gift(s) and the delivery charges incurred for the replacement shall be borne by Cardholder. The right to replacement of Gift(s) will be extinguished if a Cardholder fails to notify the Bank and return the same within the time period stipulated above.
7. The Cardholder hereby irrevocably authorises the Bank to release all pertinent information regarding the Cardholder to such relevant parties as the Bank may, in its sole and absolute discretion, employ to deliver the Gifts to the Cardholder. In this respect, the Cardholder acknowledges that the Bank shall not be held responsible for the acts or omissions of such relevant parties (including but not limited to acts or omissions relating to fraud or negligence) not in relation to the delivery of such Gifts.
General Information
 
1. All questions or disputes regarding eligibility for the SCCR or the eligibility of Choice Points in relation to accrual or the redemption of Gifts including the conversion of Choice Points to PMP points will be determined by the Bank at its sole and absolute discretion.
2. The Gifts set out in this Catalogue are valid for redemption from 1st January 2008 – 31st December 2008 or while stocks last.
3. All props, accessories or equipment featured together with the Gifts in the photographs contained herein are for decorative purposes only and do not form part of the Gifts to be redeemed by the Cardholder.
4. These terms and conditions for SCCR may be changed or varied at any time by the Bank without giving any prior notice nor assigning any reason whatsoever to the Cardholders.
5. The Bank reserves the right to suspend or terminate the SCCR at any time it deems necessary without giving any prior notice nor assigning any reason whatsoever to the Cardholders.
6. In the event where there is discrepancy between the English and the Bahasa Malaysia version of this Catalogue and the terms and conditions contained herein, the English version shall prevail.
7. Save and except for the variation stated herein all other terms and conditions in the Standard Chartered Visa and/or MasterCard Cards Cardholder Agreement shall remain valid and binding.
